2. Service Disruption: In the event of a significant service disruption that results in our inability to provide our payment processing services, we may issue refunds for the affected period.

1.2 Refund Procedure

To request a refund, please contact our customer support team via info@esicia.com. You will be required to provide relevant transaction details and any supporting documentation. We will review your request and respond in a timely manner.

1.3 Refund Limitations

Please note the following limitations on refunds:

1. Refunds will only be issued for transactions made within the last 5 days from the date of the refund request.
2. We may deduct any applicable fees, charges, or penalties from the refund amount.
3. Refunds will be processed using the original payment method, unless otherwise agreed upon.

2. Cancellation Policy

2.1 Cancellation of Services

You may cancel your subscription or terminate our services at any time by providing written notice to us. Any unused service fees or prepaid amounts will be subject to our refund policy outlined in Section 1.

2.2 Termination by ESICIA LTD (Kpay)

We reserve the right to terminate our services to you at our discretion, with or without cause, and with or without notice. In such cases, any prepaid amounts or service fees for unused services will be refunded to you in accordance with our refund policy.

By using our payment processing services, you agree to the following terms and conditions:

3.1 PCI DSS Compliance

• You acknowledge that you are responsible for maintaining PCI DSS compliance for your transactions, and you will not store, process, or transmit cardholder data without encryption and proper security measures.

3.2 Security

You agree to comply with all security measures and protocols as outlined in our PCI DSS compliance guidelines.

3.3 Privacy

We collect and process your personal information as described in our Privacy Policy, and you agree to comply with all relevant data protection laws and regulations.

3.4 Changes to Services

We reserve the right to modify, suspend, or discontinue our services at any time.

3.5 Limitation of Liability

We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our services, including any security breaches or data compromises.

4. Developer Portal Terms

In addition to the above terms, developers using the K-Pay Developer Portal agree to:

1. API Usage: Use the API only for legitimate business purposes and in accordance with the documentation provided.
2. Test Environment: Complete all required API tests before requesting production access.
3. Credentials Security: Keep all API credentials confidential and not share them with unauthorized parties.
4. IP Whitelisting: Only make API requests from whitelisted IP addresses.
5. Rate Limiting: Respect rate limits and not make excessive API calls.
6. Transaction Fees: Accept the 5% transaction fee for all successful payments processed.
